This Privacy Policy describes how Holi Resort LLC, a North Carolina limited liability company doing business as ApexHaus ("ApexHaus," "Company," "we," "us," or "our") collects, uses, stores and discloses personal information from individuals who visit or interact with ApexHaus websites, presale pages, launch pages, checkout pages and other online pages operated by or on behalf of ApexHaus (collectively, the "Sites"), or who use the services, communications and purchase opportunities made available through those Sites (collectively, the "Services").

Our Services may include providing information about the ApexHaus project, allowing individuals to request information or receive project updates, purchase an ApexKey or an ApexHaus Membership, communicate with our team, and access launch-related or member-related information.

Certain Sites, campaign pages, checkout functions, email communications or related technology services may be hosted, operated or supported through third-party service providers, including LaunchBoom, LaunchKit, approved checkout and payment providers, email marketing providers, analytics providers and advertising platforms.

We may amend this Privacy Policy from time to time. Any updated version will be posted on the Sites with a revised "Last Updated" date. Your continued use of the Sites or Services after an updated Privacy Policy is posted means that you acknowledge the updated Privacy Policy as it applies to your continued use.

When you visit our Sites, request information, sign up for communications, purchase an ApexKey or Membership, complete checkout, or otherwise interact with ApexHaus, we may collect personal information that you voluntarily provide to us or that is collected automatically through your use of the Sites.

Personal information we may collect includes: your name, email address, telephone number, mailing or billing address and other contact information; information relating to your ApexKey purchase, Membership selection, pricing eligibility, order confirmation, transaction status and customer service requests; payment and billing information provided in connection with a purchase (payments may be processed by approved third-party checkout or payment providers, and we may receive transaction and payment confirmation information from those providers — we do not intend to store full payment card numbers unless expressly disclosed); information you provide when communicating with our team, responding to surveys, requesting customer service, submitting questions or participating in communications relating to the ApexHaus project; information relating to your marketing preferences, such as whether you signed up for project updates, launch announcements or other ApexHaus communications; technical and usage information, such as your IP address, browser type, device information, referring website, pages viewed, links clicked, approximate location derived from IP address, date and time of visits and interactions with our Sites; and information collected through cookies, pixels, web beacons and similar technologies, including information relating to website traffic, advertising campaigns, page performance and visitor interactions.

By voluntarily providing personal information to us, submitting information through our Sites, requesting information, signing up for communications, or completing a purchase, you acknowledge that we may collect, use and disclose that information as described in this Privacy Policy.

We may communicate with you regarding ApexHaus products, services, launch information, Membership opportunities, project news, events and other matters that may be of interest to you.

You may not be able to opt out of certain transactional or service-related communications that are necessary for us to administer your purchase or communicate important information relating to your order, Membership, ApexKey, account activity, customer service request, security issue or legal notice.

Our Sites and Services are not directed to children under thirteen (13) years of age. We do not knowingly collect personal information from children under the age of 13.

If we learn that we have collected personal information from a child under the age of 13 without any consent that may be required by law, we will take reasonable steps to delete that information.

ApexHaus does not sell personal information for monetary consideration.

We may use advertising and analytics technologies provided by third parties to measure the performance of our Sites and advertising campaigns and to display ApexHaus-related advertising to individuals who have previously visited our Sites or shown interest in our project.
